E-Commerce

If you're starting an online business there are a lot of legal factors to consider to ensure success and to avoid greater costs in the future. Even if you have an established business or website it may be time to review your policies and contracts to make sure you comply with the most recent rules and regulations.

Privacy Policies: If you collect information from you customers or visitors you may be required by State and Federal law to provide a privacy policy regarding your use, storage, and deletion of sensitive information. Are you targeting visitors under the age of 13? Additional provisions and safeguards are required when collecting any information from younger visitors.

Terms of Use: Let us help you draft or revise your website's terms of use. Our attorneys stay abreast of the most recent cases concerning online commerce to ensure compliance with current law.

Trademarks and Domain Names

If you're starting a new business or expanding your business into new regions, you'll want to do a trademark search to make sure your name is available. In addtion to this search our attorneys can help you register your name for a low flat-rate and assist you in registering that name as a domain for your website.

If someone else is using your name for their website, or even "squatting" your mark on Facebook, Twitter, or Myspace, we can help you resolve trademark disputes anywhere someone is using your name in violation of your rights.

Intellectual Property

Whether you're a writer, an artist, or starting your own business, your intellectual property may be the most valuable asset you own; feel safe knowing an attorney is working to protect your interests. We offer flat-rate registrations services, contracts and documents necessary for transfer or licensing, as well as yearly monitoring for trademark protection.

Registration: Our attorneys have experience with both State and Federal filing for copyrights and trademarks. Let us handle the process for you for a flat rate.

Monitoring: To ensure continued protection of your trademark it is recommended that monthly searches of United States Patent and Trademark Office filings for similar or substantially confusing registrations are conducted. Our offices can perform these searches for you as well as searches of local businesses and advertisers.

Enforcement: If someone else is using your name for their website, or even "squatting" your mark on Facebook, Twitter, or Myspace, we can help you resolve trademark disputes anywhere someone is using your property in violation of your rights. We can also provide you with cease and desist letters to stop infringement of your trademarks as well as copyrights and we have experience with take-down procedures for intellectual property misuse online under the Digital Millenium Copyright Act.

Estate Planning:

Any combination of the below may be right for you. Browse our descriptions and let us know if you have any questions about what is appropriate for your situation.

Will
Legal document expressing your intentions for the management and disbursement of assets, property, and money after death. Most people planning for their estates after death will prepare a Will.

Trust
Allows for a particular person, or "trustor", to manage your assets to ensure that any "beneficiaries" receive money or property at the appropriate time and in the appropriate way after your death. This may be a helpful way to provide for children without giving them all the responsibility of money managing.

Living Trust
A Trust created and implemented while you're alive. It can be revoked at any time. Benefits include avoiding probate (the court for wills) and accounting for situations other than death, such as disability or incapacity.

Living Will
Are you concerned about who will be making decisions on your behalf if you're in a coma? A Living Will is created to be implemented in specific situations such as this. It is a legally enforceable document that indicates your desires for specified situations when you are incapable of communicating your decisions.

Powers of Attorney
This includes General Powers of Attorney and Medical Powers of Attorney. Granting someone a power of attorney means they can make decisions and act on your behalf in specified situations. They may be particularly helpful for seniors with Alzheimer's, someone undergoing a high-risk surgery, or differently-abled children, among other situations.

Do you have pets you want to provide for after you pass on? Make sure you think about all of your family members! We can help you plan for your beloved pets after you pass on. As animal lovers, we will take special care to ensure that your human and non-human family members are accounted for.

Business Formation

The first step to success in your new business is the proper formation to protect you and your investors. Whether you're interested in selling products or services under a fictitious name or setting up a Limited Liability Corporation or Nonprofit, our attorneys can evaluate your business and your concerns and recommend the proper business structure. The process of registering your business is vital to avoiding potentially costly litigation in the future as well as entanglements with the IRS and local regulations.
